CONSUMER TERMS AND CONDITIONS

Payment Methods
Live Eyewear accepts these payment methods:

  • Credit Cards: American Express, Discover, MasterCard and Visa
  • PayPal

The billing address you provide must match the billing address that is on file with the financial institution that issued the credit card. If a credit card authorization fails, we reserve the right to cancel your order without notifying you.

Live Eyewear cannot resolve credit card problems with your financial institution if a credit card is declined. It is your responsibility, as a consumer, to settle credit card problems with the issuing institution.

Returning Merchandise
Our hassle-free 30-Day Money-Back Guarantee is designed to give you peace of mind.

Changed your mind? If you aren’t delighted with your purchase, you can return a product within 30 days and we will happily refund the purchase price.

You can return most new, resaleable items within 30 days of delivery for a full refund, as noted below:

  • There is no need to contact us to initiate a return.
  • Simply ship the products back to us (Attn: Returns and Exchanges) and indicate that you wish to return or exchange the products.  If you would like to exchange your Cocoons, please indicate the size you wish to receive and include a check for $8.95 for return shipping and handling.  The return address is:

  • If you are asking for a refund, it will be for the full value of the returned items, unless otherwise noted.
  • Shipping and handling fees will not be refunded.  As you are responsible for shipping the products back to us, we recommend using a trackable shipping method.
  • Credit for returned items will be applied to the credit method that was used to make the purchase. Returns will be applied to the purchasing credit card within 5 to 10 days of the date that the return is accepted by Live Eyewear.
  • If any items or packaging are not returned or are damaged, a restocking fee may apply.

 

Individual products may be excluded from this guarantee.

Refunds, Credits and Balances Due
Your credit card should be credited within 10 business days of the time Live Eyewear receives your returned merchandise. The return credit should be reflected on your statement within one or two billing periods, depending on your financial institution’s billing cycle.

Defective Items
A defective item is one that is inoperable but has no apparent damage. If you receive defective merchandise, please call Live Eyewear for assistance.

Damaged Items
If an order arrives to you with obvious shipping damage, please refuse the delivery. If you have accepted delivery and then find shipping damage, please call Live Eyewear immediately using the contact information included with the order.

Please save all packaging material and paperwork for the order if shipping damage is a possible issue. If you dispose of packaging material or attempt to return the merchandise without contacting Live Eyewear, you may not receive credit for the return.

Limits of Responsibility
We accept no responsibility for user-initiated damage and/or loss of parts incurred during operation or use of product.

International and U.S. Territory Shipping
International locations or US territory shipping destinations are identified at checkout. When you begin checkout, available shipping destinations can be selected from pull-down menus for Region and Country. If your desired destination is not included in the available selections, we cannot ship orders to that location.  FOR INTERNATIONAL SHIPMENTS:  Buyer is responsible for shipping fees, including but not limited to and and all duties, taxes and any other fees (such as customs fees) that may be charged by the destination country.  The products are listed on the site in US Dollars.  International customers will be charged according to the then current exchange rate.

Price and/or Description Changes
All prices, pictures, and descriptions on this website are subject to change. We maintain no responsibility for inadvertent errors. Please contact us within 30 days regarding price or promotion discrepancies.

When you place your order with us, you agree to the price and terms indicated on this website. Price differences related to future or past prices in our store or any other store are not refundable.

Order Questions or Changes
If you have recently placed an order using the Live Eyewear website and need information about us or would like to change your order, there are a number of ways to contact us. If you have explored the links on the Your Account page but still need assistance, contact Live Eyewear Customer Service at 800-834-2563.

Indemnification
You agree to indemnify, defend, and hold harmless Live Eyewear, its affiliates, officers, directors, employees, consultants, and agents from any and all claims, liability (including product liability), damages, and/or costs (including, but not limited to, attorneys’ fees) that arise from your use of any of Live Eyewear’s services.

Errors on Our Site
Prices and availability of products are subject to change without notice. Errors will be corrected where and when discovered. Live Eyewear reserves the right to revoke any stated offer, cancel orders, and to correct any errors, inaccuracies or omissions in any stated offer or price, including after an order has been submitted and whether or not the order has been confirmed and your payment processed.

If your payment has already been processed for the purchase when your order is cancelled, Live Eyewear will issue a credit to the payment method used in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account.

If you are not fully satisfied with your purchase, you may return it in accordance with Live Eyewear’s Return Policy.

GIFT CARD TERMS AND CONDITIONS

General Terms
Live Eyewear electronic Cocoons Gift Cards are provided directly from Live Eyewear, Inc., a California corporation.  By visiting www.CocoonsEyewear.com, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern these Cocoons Gift Card Terms and Conditions (“T&Cs”). Live Eyewear reserves the right to change these T&Cs from time to time in its discretion.

Electronic Gift Cards
Live Eyewear electronic Cocoons Gift Cards are only available for purchase from www.CocoonsEyewear.com.  Live Eyewear Cocoons Gift Cards are only redeemable for merchandise at www.CocoonsEyewear.com.  No service or use fees of any kind will be imposed on purchasers or recipients of Cocoons Gift Cards.

Redemption
To redeem your Live Eyewear Cocoons Gift Card follow the instructions below your Cocoons Gift Card, in the email message which notified you of your gift.

Returns
You may not return or cancel your Live Eyewear Cocoons Gift Card after it is received. Purchasers who wish to cancel a Cocoons Gift Card purchase order prior to its delivery to a recipient should contact Live Eyewear Customer Support prior to the delivery date selected during the purchase process.

Lost or Stolen Gift Cards
Live Eyewear Cocoons Gift Cards should be treated like cash and safeguarded accordingly. Cocoons Gift Cards will not be replaced if lost or stolen.

Limitations
The maximum value that can be associated with any one Cocoons Gift Card is five hundred dollars ($500.00) and total purchases for any one individual may not exceed ten thousand dollars ($10,000.00) in one calendar day. You may not use a Cocoons Gift Card to purchase other Cocoons Gift Cards. Cocoons Gift Cards cannot be reloaded, resold, transferred for value, or redeemed for cash, except to the extent required by law. Void if resold, transferred for value, or redeemed for cash. Unused Cocoons Gift Cards may not be transferred.

Our Policies
Information that you provide when purchasing a Cocoons Gift Card is subject to Live Eyewear’s Privacy Policy. Live Eyewear may provide Cocoons Gift Card purchasers with information about the redemption status of Cocoons Gift Cards.

Risk of Loss
Ownership and risk of loss of Cocoons Gift Cards passes to the purchaser as soon as we send our confirmation to the recipient and risk of loss passes to the recipient as soon as an Cocoons Gift card is delivered to the recipient’s email. We are not responsible for lost or stolen Cocoons Gift Cards. If you have any questions, please see the sub section on Cocoons Gift Cards in our FAQ’s for additional information.

If you need assistance with any aspect of your purchase, ownership, or use of your Cocoons Gift Card, please contact Live Eyewear Customer Support. Please refer to your order number, or email address.

Gift Cards may be paid for with a valid VISA, MasterCard, Discover, or American Express card or with PayPal.

Delivery Information and Requirements for Cocoons Gift Card Purchasers
All orders of Cocoons Gift Cards are subject to a process that compares purchaser information provided on the web site with information about the purchaser provided by the purchaser’s financial institution. If there is a discrepancy, your Cocoons Gift Card order may be delayed until it can be corrected. If the date on which you want a Cocoons Gift Card delivered has passed and you have not received confirmation that the Cocoons Gift Card has been sent, please contact Live Eyewear Customer Support. Please refer to your order number, or email address. Live Eyewear is not responsible for Cocoons Gift Cards that are undeliverable or not received due to your failure to enter an accurate email address for the recipient. Please check to make sure the email address for the recipient is correct and contact Live Eyewear Customer Support if you suspect the recipient did not receive their Cocoons Gift Card. Should an email be returned to us due to inaccurate delivery information for the recipient, we will attempt to contact you for a valid email address.

Reasons for Failed Delivery of Cocoons Gift Cards
If you have confirmed the recipient’s email address but the Cocoons Gift Card has not been redeemed within a reasonable period after the requested delivery date, following is a list of the most common reasons why delivery may have failed:

  • Spam filter blocked email or routed it to a bulk/spam folder
  • Recipient’s firewall blocked the email
  • Email inbox is over size limit
  • Invalid email address

If a spam filter is blocking orders@liveeyewear.com emails from getting to an inbox, the email options will need to be modified so that orders@liveeyewear.com emails are not considered spam. If you need further assistance, contact Live Eyewear Customer Support. Please refer to your order number or email address.

Personalized Messaging
If you wish to add a personal message to an electronic Cocoons Gift Card, simply type your message in the Message field prior to adding the electronic Cocoons Gift Card to your cart. Personal messages are limited in length to the space provided on the electronic Cocoons Gift Card. There is no additional charge to include a personalized message. If we find inappropriate, offensive or otherwise objectionable messages, we reserve the right to cancel the message. Thanks for your cooperation.

Limitation of Liability 
LIVE EYEWEAR AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A COCOONS GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH COCOONS GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

Disputes
You hereby consent that any dispute relating in any way to Live Cocoons Gift Cards shall be adjudicated in San Luis Obispo County, California and you consent to exclusive jurisdiction and venue in such courts.
